Terms of Service

1. Acceptance
By accessing or using Rooftop and its modules (AutoCurb, AutoLabels, AutoFilm, AutoFrame), the dealership ("Customer") agrees to these Terms and the signed Master Services Agreement (MSA). Where the MSA conflicts with these Terms, the MSA governs.
2. Pilot & subscription
The 60-day pilot is offered free of charge for a single rooftop. After the pilot, the Customer may convert to a paid subscription (Rooftop tier or Group tier) on a month-to-month basis with no cancellation penalty, or annual with two months free. Pilots that don't convert auto-archive after 30 days; the Customer can re-activate within 90 days without re-onboarding.
3. Customer data ownership
The Customer owns all data submitted to or captured by Rooftop on the Customer's behalf, including consumer records, vehicle records, audit trails, photos, and videos. Rooftop processes this data solely to deliver the Service. Export and deletion are available through the dashboard at any time.
4. Acceptable use
The Customer may not use Rooftop to (a) violate the FTC CARS Rule, TCPA, or state-level disclosure / consent laws, (b) misrepresent vehicle condition, history, or pricing, (c) impersonate another dealer or brand, (d) reverse-engineer the Service. Rooftop's compliance gates exist as a safety net, not a substitute for the Customer's own legal counsel.
5. Service availability
Rooftop targets 99.9% monthly uptime for paid tiers, measured at rooftopos.io/health. Scheduled maintenance is announced in advance via the dashboard.
6. Pricing & payment
$1,499 per rooftop per month (Rooftop tier) or custom (Group tier). Annual billing receives two months free. Add-on modules (AutoLabels, AutoFilm, AutoFrame as they launch) priced at module GA. The pilot includes the AutoCurb full feature set with no card on file.
7. Termination
Either party may terminate with 30 days' notice. The Customer's data is exportable for 90 days after termination, then deleted (audit records retained 7 years per FTC / state record-keeping requirements).
8. Limitation of liability
Rooftop's aggregate liability is capped at the fees paid by the Customer in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.
9. Governing law
These Terms are governed by the laws of the State of Connecticut, USA.
