Terms of Service

1. Acceptance

By accessing or using RooftopOS and its applications (AutoCurb, AutoLabels, AutoFilm), the dealership ("Customer") agrees to these Terms and the signed Master Services Agreement (MSA). Where the MSA conflicts with these Terms, the MSA governs.

2. Proof of Value & subscription

The Structured 60-Day Proof of Value is a scoped evaluation on a single rooftop, carried out under a written evaluation plan agreed before go-live. The commercial terms of the evaluation period — including any fee — are set in the scoping conversation and confirmed in writing before it starts. Nothing converts automatically: deployment begins only when the Customer signs an order form. If no order form is signed, the evaluation ends and the Customer’s data is returned in accordance with Section 3.

Billing frequency, term length, renewal, and cancellation are set in the executed order form for each rooftop. /pricing describes the per-rooftop subscription model; it publishes no tier, rate, term, or usage limit, and no such figure is asserted here. Where the signed MSA or order form states commercial terms, those govern.

3. Customer data ownership

The Customer owns all data submitted to or captured by RooftopOS on the Customer's behalf, including consumer records, vehicle records, disclosure and consent records, photos, and videos. RooftopOS processes this data solely to deliver the Service. Export and deletion are requested by contacting RooftopOS and are carried out by the RooftopOS team; there is no self-service export or deletion control in the product today, and none is represented here. The timeframes and any retention schedule that apply to a request are set in the executed agreement. What RooftopOS does and does not operate is stated on the Trust Center.

4. Acceptable use

The Customer may not use RooftopOS to (a) violate the FTC Act, TCPA, or state-level disclosure / consent laws, (b) misrepresent vehicle condition, history, or pricing, (c) impersonate another dealer or brand, (d) reverse-engineer the Service. The disclosure and consent steps a Customer configures in RooftopOS are workflow and recordkeeping, not a substitute for the Customer's own legal counsel, and RooftopOS does not warrant a compliance outcome.

5. Service availability

RooftopOS operates to an internal availability target of 99.9% monthly for paid subscriptions. That is an operational target, not a contractual service-level agreement, and it carries no service credit. Any binding availability commitment exists only where the signed MSA states one. Current service health is published at rooftopos.io/status. Scheduled maintenance is announced in advance via the dashboard.

6. Pricing & payment

RooftopOS is sold as a per-rooftop software subscription. The connected RooftopOS Platform and each individual application — AutoCurb, AutoLabels, and AutoFilm — are scoped and quoted, as are multi-rooftop groups. No rate, tier, discount, or usage allowance is published on rooftopos.io/pricing or anywhere else on this site; the amounts payable, the billing frequency, and the invoicing terms are those written into the executed order form.

7. Termination

Either party may terminate with 30 days' notice, unless the executed agreement states otherwise. After termination RooftopOS returns or deletes Customer data on the schedule written into that agreement; no return window or deletion turnaround is published here, because none has been set for publication. Dealerships remain subject to their own federal and state record-keeping obligations, and where those require records to be preserved beyond termination the categories and periods are identified in the executed agreement rather than asserted on this page.

8. Limitation of liability

RooftopOS's aggregate liability is capped at the fees paid by the Customer in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.

9. Governing law

These Terms are governed by the laws of the State of Connecticut, USA.
